Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you and Bouncer ("Company," "we," "our," or "us") governing your use of the Bouncer iOS app and related website services (collectively, the "Service").

By downloading, accessing, or using Bouncer, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and Compliance

You must be able to form a binding legal agreement in your jurisdiction to use Bouncer. You are responsible for using the Service in compliance with all applicable laws, regulations, and Apple App Store rules.

3. Description of Service

Bouncer is a productivity and study tool that helps users limit access to selected distracting apps while they complete flashcard-based study challenges.

We may change, improve, or discontinue parts of the Service at any time to maintain quality, security, and product direction.

Bouncer supports better habits, but it cannot guarantee academic performance, grades, or study outcomes.

4. Accounts and Device Access

The current version of Bouncer does not require account registration or login. Because there is no account system, account deletion is not currently applicable.

You are responsible for maintaining security of your device, passcode/biometric access, and Apple account credentials.

5. Subscriptions and Billing

  • Paid features may be offered through auto-renewing subscriptions.
  • Billing is handled by Apple through your App Store account, not directly by us.
  • Subscription pricing, trial terms, and renewal periods are shown in the app before purchase.
  • You can manage or cancel subscriptions in your Apple subscription settings.
  • Refunds are handled by Apple according to App Store rules and policies.
  • Restore purchases is available in the app.
  • RevenueCat may be used to validate subscription status and paid feature access.

6. Apple Permissions for Blocking

App blocking and app selection features require Apple Screen Time / FamilyControls permission. Bouncer uses this permission so you can select apps to block, apply shields to those selected apps, and enforce unlock timers after study challenges.

App selections are represented by Apple privacy-preserving tokens and are used to provide the blocking features you configure.

If permission is not granted or is later removed in iOS Settings, related blocking features may not work.

7. Apple EULA and License

Unless a separate custom EULA is provided, Bouncer is licensed to you under Apple's Standard Licensed Application End User License Agreement (EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

Subject to these Terms and the applicable EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to use Bouncer for personal, non-commercial use on Apple-branded devices you own or control.

8. Intellectual Property

The Service, including software, design, text, graphics, trademarks, and branding, is owned by Bouncer or its licensors and protected by intellectual property laws.

9. User Content and Responsibilities

You may create or import study content (for example, cards, notes, prompts, and folders). You retain rights to your content, but you are responsible for ensuring you have the rights needed to use it.

AI-generated flashcards may be incomplete or inaccurate, and you should review them before relying on them for study decisions.

Do not submit private or sensitive information to AI generation.

You agree not to:

  • Use the Service for unlawful, abusive, or fraudulent purposes.
  • Attempt to reverse engineer, decompile, or interfere with app security mechanisms.
  • Circumvent technical limitations intended to enforce app blocking.
  • Upload malicious code or content that harms the Service.
  • Infringe intellectual property or privacy rights of others.

10. Acceptable Use and Fair Access

We may investigate misuse and take action to protect the Service, including limiting features, suspending access, or removing harmful content where legally required.

11. Availability and Changes

We aim for reliable operation but do not guarantee uninterrupted or error-free access. Maintenance, iOS updates, provider outages, or other issues may affect functionality.

12. Third-Party Services

Bouncer may rely on third-party services including Apple App Store billing, RevenueCat subscription infrastructure, and Firebase Analytics/Crashlytics for analytics, debugging, and reliability. Your use of those services may also be governed by third-party terms and policies.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that Bouncer will always block every distraction, produce accurate AI outputs, meet every expected result, or be available at all times.

14. Limitation of Liability

To the fullest extent permitted by law, Bouncer and its affiliates, officers, employees, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, revenue, profits, or goodwill arising from or related to your use of the Service.

Where liability cannot be excluded, our total liability is limited to the amount you paid for the Service in the twelve (12) months before the event giving rise to liability.

15. Indemnification

You agree to defend, indemnify, and hold harmless Bouncer and its affiliates from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your content, or your violation of these Terms or applicable law.

16. Suspension and Termination

We may suspend or terminate access to the Service if you materially violate these Terms, create security risk, or use the Service in a way that may cause harm.

You may stop using Bouncer at any time by uninstalling the app and canceling any active subscriptions through Apple.

17. Governing Law

These Terms apply to users worldwide. To the extent permitted by applicable law, these Terms are governed by the laws of Victoria, Australia, without regard to conflict of laws principles, and disputes will be handled in the courts of Melbourne, Victoria, Australia, unless mandatory local consumer law provides otherwise.

18. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date and may provide additional notice in the app or on this website.

Your continued use of the Service after updated Terms become effective means you accept the revised Terms.
